Our practice covers employment contracts and policies, workforce restructuring and termination (PHK), severance pay and entitlement calculations, expatriate work permits (KITAS/KITAP), manpower reporting obligations, and the structuring of benefits and remuneration packages. We provide day-to-day employment advisory, helping clients navigate the complexities of Indonesia's Manpower Law (Law No. 13/2003) and the Job Creation Law as affirmed by the Constitutional Court, including the latest implementing government regulations on minimum wage and fixed-term employment. Our team regularly advises on collective labor agreement (PKB) negotiations, implementation of company regulations (PP Perusahaan), and outsourcing arrangements. We assist clients with the practical management of mass layoffs and workforce restructuring programs, including coordination with the Department of Manpower (Disnaker), bipartite council procedures, and communication strategies to minimize industrial relations risk. For companies with expatriate workforces, we provide end-to-end permit management and advise on TKA ratio compliance. In disputes, we represent employers in the industrial relations court (PHI), mediation and conciliation proceedings before the Department of Manpower, and labor arbitration.
